Welcome to Consumer One. These Terms of Service ("Terms") govern your access to and use of our website and services. By accessing or using our services, you agree to be bound by these Terms.

2.1 Lead Generation Service

Consumer One operates as a lead generation and referral service. We connect consumers seeking debt relief assistance with third-party debt relief companies, service providers, and partners ("Partners"). We do not provide debt relief services directly.

2.2 No Guarantee of Services

We do not guarantee that:

  • You will be matched with a Partner
  • Any Partner will accept you as a client
  • You will qualify for any debt relief program
  • You will achieve any specific debt relief outcome
  • Any Partner will contact you within a specific timeframe

2.3 Partner Relationships

Our Partners are independent third parties. We do not control, endorse, or guarantee the quality, legality, or safety of their services. Any agreement you enter into with a Partner is solely between you and that Partner.

3. Eligibility and User Responsibilities

3.1 Age Requirement

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are at least 18 years of age.

3.2 Accurate Information

You agree to provide accurate, current, and complete information when submitting our form or communicating with us. You are responsible for maintaining the accuracy of your information and updating it as necessary.

3.3 Prohibited Uses

You agree not to use our services for any unlawful purpose or in any way that:

  • Violates any applicable law or regulation
  • Infringes on the rights of others
  • Contains false, misleading, or fraudulent information

You may receive communications from multiple Partners. Each Partner's use of your information is governed by their own privacy policy and terms of service.

4.3 Opting Out

You may opt out of future communications from us by following the unsubscribe instructions in our emails or by contacting us directly. However, we cannot control communications from Partners once your information has been shared. To stop communications from a Partner, you must contact that Partner directly.

5. No Debt Relief Services

5.1 Referral Only

Consumer One is a referral service only. We do not:

  • Provide debt settlement, consolidation, or counseling services
  • Negotiate with creditors on your behalf
  • Provide legal, financial, or tax advice
  • Guarantee any specific debt relief outcome
  • Represent or act as your agent

5.2 Independent Advice

We strongly encourage you to:

  • Consult with a qualified financial advisor, attorney, or tax professional before making any debt relief decisions
  • Carefully review all agreements before signing with any Partner
  • Understand the potential impact on your credit score and financial situation
  • Research and verify the credentials of any Partner before engaging their services

6. Disclaimers and Limitations of Liability

6.1 No Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties of accuracy, reliability, or completeness of information
  • Warranties that our services will be uninterrupted or error-free
  • Warranties regarding the quality or suitability of Partner services

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSUMER ONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

This includes, but is not limited to, damages for:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Credit score damage
  • Financial losses resulting from Partner services
  • Emotional distress or personal injury

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 OR THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

6.3 Partner Actions

We are not responsible for the actions, omissions, or services of our Partners. Any disputes, claims, or issues arising from your relationship with a Partner must be resolved directly with that Partner.

7. Indemnification

You agree to indemnify, defend, and hold harmless Consumer One, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of the rights of any third party
  • Any information you submit to us

8. Intellectual Property

8.1 Ownership

All content on our website, including text, graphics, logos, images, software, and design, is the property of Consumer One or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. You may not:

  • Use our trademarks or branding without authorization

10. Compensation and Affiliate Relationships

Consumer One may receive compensation from Partners when we refer consumers to them. This compensation may be based on:

  • Lead generation (payment per referral)
  • Enrollment (payment when you sign up with a Partner)
  • Performance (payment based on outcomes)

10.2 No Additional Cost

Our referral fees do not result in any additional cost to you. Any fees you pay are determined solely by the Partner you choose to work with.

11. Privacy and Data Security

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Termination

12.1 Right to Terminate

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice.

12.2 Effect of Termination

Upon termination:

  • Your right to use our services will immediately cease
  • We may delete your account and information
  • Provisions of these Terms that by their nature should survive termination will remain in effect

13. Dispute Resolution

13.4 Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to us within 30 days of first using our services. The notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Consumer One regarding our services and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
